- Abstract
The article discusses habeas corpus claims and defenses raised in Idaho under the U.S. Constitution's Double Jeopardy Clause in the wake of the U.S. Supreme Court's (USSC's) ruling in the 2013 criminal law case Evans v. Michigan and the 2003 Idaho Supreme Court case State v. Korsen which deals with an acquittal and the retrial of criminal defendants. Collateral relief is examined, along with the retroactivity of USSC decisions and the 1989 criminal procedure case Teague v. Lane.
