- Abstract
The article "How can one acquire a virtual object in a metaverse? - A reevaluation of the concept of property according to § 90 of the German Civil Code in the context of the 'metaverse'" deals with legal questions regarding the acquisition of virtual objects in a metaverse. It discusses whether virtual objects can be considered as "property" within the meaning of § 90 of the German Civil Code and what implications this would have for the legal assessment of the metaverse. The metaverse is described as a collective virtual space in which users navigate through avatars and can participate in various activities. Various mechanisms for acquiring virtual objects in the metaverse are discussed, including purchasing through marketplaces and the use of digital currencies or non-fungible tokens (NFTs). The use of data gloves in virtual realities, which have a certain tangible physicality, is also addressed. The question of whether virtual objects can be considered as property is controversially discussed. It is emphasized that the development of the metaverse and the consideration of technological, social, and regulatory factors are important. It is argued that a legal regulation should be established to equate digital content with property.
