- Abstract
The article discusses the state of products liability jurisprudence in South Carolina. The court used the consumer expectations test in 1978 as the standard for products of defective design. In 1982, the court stated that they opted instead for the risk-utility balancing as a standard, without outmoding the former. As a result, the liability standard in the state is unclear, and a proposal is offered which aims to balance consumer expectations with one that ensures manufacturers create safe, reliable products.
