The article explores the use of domestic and foreign laws to counteract cross-border investment fraud. It challenges the view of securities law as public law not amenable to choice of law. A brief discussion of judicial treatment of the limits of extraterritorial application of domestic law in antitrust cases in the U.S. is presented.
