- Abstract
This article focuses on the court ruling given in Salvatore v. Allied Chemical Corp. case. Seniority rights cannot be claimed in court action when collective bargaining agreement provided for exclusive grievance and arbitration procedure. Allegation that employer breached the agreement by failing to accord seniority rights does not authorize other redress. The court said: "Federal substantive law requires that the individual employee resort to the use of any contractual grievance procedure."
