- Abstract
In this article the author analyzes the enforcement loophole of the Lago Agrio court's judgment in Ecuador on Chevron Texaco Corp. for improper waste disposal from its oil wells into rivers. It pertains to the defendant's use of defenses to foreign country judgment. The author says that in this practice, the defendant can manipulate foreign litigation. She emphasizes that the company's alleged exploitation of the loophole is a strategy to avoid large judgment payout for tort actions abroad.
