- Abstract
When a song gains some degree of traction in the music market, hundreds of "cover versions" of it can be expected to follow. These "covers" often end up on YouTube, the world's largest video-sharing site. But these "music cover videos" on YouTube occupy uncertain territory within the law of copyright, resulting in the uncertain and sometimes unjustified application of YouTube's robust copyright management tools against them. In light of the above, this empirical legal research paper serves two purposes: first, it presents an overview of YouTube's full suite of copyright management tools; and second, it presents the empirical results of a survey conducted on 53 YouTube music cover artists, with the aim of identifying these artists' familiarity and concerns with YouTube's copyright management tools. It finds that the music cover artists sampled have a fair degree of familiarity towards various concepts of copyright law, but are generally concerned with how YouTube's copyright management tools are applied in practice.
