- Abstract
The article discusses a court case wherein the Tenth Circuit ruled in favor of a marketing company in an infringement case concerning a geographically descriptive mark. In Vail Associates (VA) v. Vend-Tel-Co., the former sued the latter for service mark infringement in violation of the federal Lanham Act. VA claimed that a phone number being used by the latter was likely to cause confusion among consumers attempting to reach VA. The author believes that the Tenth Circuit's decision threatened the enforceability of the geographically descriptive marks.
