- Abstract
The article presents an overview regarding the purpose and parameters of Florida's Deceptive and Unfair Trade Practices Act (FDUTPA) on a private claim alleging a deceptive, unfair and unconscionable act or practice in the conduct of any trade. It focuses on the tests for deception, unfairness and unconscionability and how these tests relate to analogous federal consumer protection law. It also discusses three circumstances that likely contributed to the "federal flavor" of FDUTPA that rendered the law still subject to development.
