- Abstract
This article presents the U.S. court decision on the case of Reliance Drug Co. v. Finke. The court observed that where a stockholder's agreement provided for arbitration of buy-out disputes and valuation of stock, the Appellate Division remanded the dispute over granting a stay of arbitration for a determination of the existence of an agreement by the stockholders as to the value. The trial court had denied the stay and on appeal the Appellate Division held the matter in abeyance pending a determination of the existence of the agreement as to value.
