REVIEW OF RECENT UNINSURED MOTORIST CASE LAW.
- Abstract
This article lists the review of recent uninsured motorist case law in the U.S. An uninsured motorcycle is not an uninsured automobile within uninsured motorcycle coverage. Insured, injured by stone thrown by unidentified person in unidentified automobile, may not recover on uninsured motorcycle policy, as injury does not arise out of ownership, maintenance or use of motor vehicle. Enactment of uninsured motorcycle statute does not affect validity of reducing clause. Rejection of uninsured motorcycle coverage by spouse without knowledge of named insured held invalid even though spouse was resident of household.
