- Authors
Carlson, David Gray
- Abstract
The article attempts to retire mere conduit, a legal fiction employed in fraudulent transfer and avoidance theory law, from the lexicon of U.S. law. It discusses fraudulent transfers and the U.S. federal bankruptcy law on stolen funds and benefited entities. It analyzes legal and equitable title, bailments, consignments, secure creditors as mere conduits, banks as more than mere conduits, conduits, setoffs and security interests in deposit accounts, banks acting in bad faith, and safe harbor.
