- Abstract
The article discusses the investigation of the import infringement of patent by the U.S. International Trade Commission (ITC). It says that an exclusion order can only be granted to be enforced by the U.S. Customs and Border Protection after an infringement was found to exist. It explores the Section 337 of the Tariff Act of 1930 that declares that the infringement of a U.S. patent or a copyright registered under Title 17, a registered trademark, and other rights are unlawful import practices.
