- Abstract
The article presents U.S. legal cases and developments in marketing relative to the regulation of unfair competition. In reference to advertising the Sterling Drug v. Federal Trade Commission and the Wick v. Tucson Newspapers, Inc. cases are cited. In the former case the U.S. Court of Appeals for the Ninth Circuit upheld the U.S. Federal Trade Commission's (FTC) order to cease and desist advertising for certain manufacturer's over-the-counter pain killers. In 1984 the FTC ordered that associations representing hotels, motels, and other lodgings for travelers could not prohibit their members from advertising or posting room prices.
