- Abstract
The article examines the case Bear Gulch Solar, LLC v. Montana Public Service Commission to analyze the legality of the 1973 Public Utility Regulatory Policies Act legally enforceable obligation (PURPA LEO). Also cited are the growing use of PURPA by facilities to sign purchase agreements with public utilities, and some qualifying facilities (QF) like renewable energy producers.
