- Abstract
The article discusses the Minnesota Supreme Court's determination in the 2012 case Quade v. Secura Insurance Cos. that the statutorily mandated appraisal clauses in special property insurance contracts require insurance appraisers to make decisions regarding the value and the cause of a loss. Insurance contract laws are addressed, along with the court's ruling which states that an appraisal is a condition precedent to litigation. Liability and interpretations of insurance policies are examined.
