- Abstract
The article discusses the Minnesota Supreme Court's ruling in the 2011 case State ex rel. Commissioner of Transportation v. Kettleson which deals with a public use provision in the state's eminent domain (ED) doctrine and the Minnesota government's use of ED to acquire property for a road re-construction project. Legislative intent and the differences between private and public roads are examined, as well as the Minnesota Department of Transportation's ED authority.
