- Abstract
The article discusses the need for the development of a more comprehensive sustainable energy law that will cater future challenges of renewable development in the U.S., focusing on the utility-scale renewables. It describes the conflicting laws used by federal, state, and local levels for each stage of renewable development, as well as identify the gaps and suggests how such laws should be enhanced to deal with the challenges. It claims the more scholarly and legislative focus should be given to the formulation of renewable energy law to address the eternal conflict between flexibility and predictability of laws. It adds that development of such a law must not only balance environmental and economic interests but protect human safety and health as well.
