The article analyzes the incorporation of privacy within antitrust analysis and reflects on the antitrust rule that limits firms' ability to collect consumer data. It examines various limitations imposed by antitrust law in light of the U.S. Constitution First Amendment protections and states that allowing antitrust enforcers to consider privacy would inject an undesirable level of subjectivity into antitrust enforcement decisions.
