The article argues Takings Clause, of the Fifth Amendment to the U.S. constitution, provides that private property be taken for public use without just compensation, so how does the Takings Clause fit into intellectual property rights. Topics discussed include provisions of America Invents Act and Copyright Act; and decision of the District Court for the Central District of California in the case "Estate of Graham v. Sotheby's."
