Allocation of Costs in International Arbitration*.
- Authors
Reed, Lucy
- Abstract
The article discusses the allocations of costs by tribunals for arbitral proceedings. The guidelines for allocation of costs include contract agreements by both parties for cost allocation and arbitration rules. According to the UNCITRAL Arbitration Rules, the basic principle is that the costs of the arbitration shall be borne by the unsuccessful party and the tribunal also has the discretion to allocate the costs reasonably, taking into account the circumstances of the case.
