- Abstract
The article focuses on the legal power of municipalities to restrict pesticide which the Supreme Court unanimously supported in Hudson, Quebec. Significantly, the court have denied an appeal by two lawn care companies and that it confirmed that the municipalities had the power to set by-laws that respond to community concerns that aims to protect public welfare. Furthermore, the municipality by-law bans pesticide across the board. Moreover, citizens and community groups can apply to the Canadian Environmental Law Association (CELA) and the Sierra Legal Defence Fund (SLDF) for representation wherein the decision of the CELA or SLDF to take such cases is not made lightly. Finally, the Hudson decision has implications for all municipalities in the country.
