- Abstract
The article provides information on the Digital Millenium Copyright Act (DMCA) in the U.S. according to which technological protection measures (TPMs) to prevent alterations to the hardware and software of smartphone are prohibited as acts of illegal circumvention. It informs that the act of jailbreaking an smartphone may create liability in three ways including breach of contract, copyright infringement, and as an act of illegal circumvention.
