- Abstract
The article examines the possible impact to small entity inventors, particularly those from academic enterprises, of the shift from first to invent (FTI) system to first inventor to file (FITF) system for patent application in the U.S. It also examines the costs and benefits associated with FTI and FITF systems, as well as the impact each may have on small entity inventors. It discusses the importance of the one-year grace period for filing patent applications to independent and academic inventors, which is unavailable in most other countries. Moreover, it resolves that the U.S. adoption of FITF should only continue along with the adoption of a one-year grace period by the other major patent-granting countries.
