- Abstract
The article focuses on the limitations of Batson case decision when dealing with constitutional violations. It presents information on the U.S. Supreme Court's decision in Batson v. Kentucky, wherein unconstitutional discriminatory use of peremptory challenges was analyzed to provide basic remedies in violations. It discusses issues related to jury selection and use of Batson violations by judges as a tool to distinguish different levels of culpability in using peremptory challenges.
