- Abstract
The article discusses how disparate impact litigation alone is insufficient to provide formerly incarcerated people access to safe, affordable, and stable housing. Topics discussed include the U.S. Department of Housing & Urban Development's regulations and guidance and the Court's recognition of the disparate impact theory under the Fair Housing Act; the U.S. Supreme Court's decision in the case "Texas v. Inclusive Communities;" and single party dominance of the legislative branches.
