- Abstract
The article examines the availability of court orders supporting the taking of evidence from third parties to foreign arbitration proceedings in the case A v. C in England. Topics include the argument that the holding in A v. C opens up the powers of an English court to make orders against third parties for the production of documents, the loss of the U.S. Code 1782 as a means of obtaining evidence in foreign commercial arbitration, and the provisions of the Arbitration Act 1996 in England.
