- Abstract
This Article deals with the question of how involvement of civil society organizations (CSOs) at the international level can foster a democratization of international organizations and lawmaking processes. With reference to democratic theory and the current legal practice of CSO involvement, I reconstruct two theoretical perspectives that give two separate accounts of the democratic potential of CSO participation. My argument relies on a "mobilization model" of CSO intervention, drawing on deliberative theory to conceptualize CSOs as a means of expressing the will of a mobilized public. By acknowledging CSO activity as a form of "representation without election," I confront recent debates about the lack of legitimacy of CSOs. I argue that CSO involvement can have a democratizing impact, but also point out its limits: CSOs are suitable for a punctual democratization of specific processes, but their activity is too focused to account for an overall democratization of the international legal system.
