- Title
German Unfair Competition Law and the GDPR – Courts Are Indecisive about Parallel Remedies.
- Authors
Henrich, Jan
- Abstract
The article looks at the failure of German courts in clarifying how the General Data Protection Regulation (GDPR) and national unfair competition law interrelate with each other. It mentions that the Regional Court of Bochum decided that the GDPR violations cannot be claimed under unfair competition law. It states that a case is pending before the Court of Justice of the European Union (CJEU) regarding a privacy issue with a social media plugin.
