- Abstract
The article analyzes the causes, consequences, and lasting results of Germany's amendment of § 116 in the Arbeitsförderungsgesetz (Promotion of Employment Act) of 1986. The legislation addressed and fundamentally altered the relationship between trade unions and the German state, such that the unions' sphere of action was revised in terms of collective negotiation, while the state took a stance of non-intervention. The divergent views of parliamentary actors of the government of Chancellor Helmut Kohl are examined, as well as the economic, political, and judicial results of the final legislation and its long-term impact on the structure of labor and flexibility of labor conditions.
