- Abstract
This Comment analyzes the often-confusing economic loss doctrine. Born in products liability, the economic loss doctrine prevents tort recovery under strict liability if there is solely an economic loss. This Comment is unique because it ponders the effect of the economic loss doctrine on claims of intentional or negligent misrepresentation. It focuses on the overall legal theories of contract and tort law and the respective available damages under each theory. It further evaluates different jurisdictional approaches to the economic loss doctrine proposing a solution for applying the economic loss doctrine fairly to claims of intentional and negligent misrepresentation in Missouri.
