An essay is presented on criminal sentencing in the U.S. as of May 2012, focusing on the role of empathy for a defendant in a judge's decision making process regarding sentencing. According to the article, a judge's reliance on the provisions of the U.S. Sentencing Reform Act of 1984, the nation's Sentencing Guidelines, and the Federal Rules of Criminal Procedure will ensure the fair and reasonable sentencing of each defendant.
