- Abstract
The article explores the issues of the second-generation dispute system design (DSD) in managing settlements. The author offers examinations of two settlement distribution designs to consider some of the second-generation problems and solutions. The settlement distribution designs include the currency conversion fee antitrust litigation and the pharmaceutical industry average wholesale price litigation. An overview of the tensions derived from the settlement distribution process is presented.
