The article discusses judicial estoppel and the duty to defend in no-injury product liability litigation with a focus on the U.S. court case Medmarc Casualty Insurance Co. v. Avent America, Inc. It examines the doctrine of judicial estoppel, the application of the doctrine to insurance coverage actions, and implications for judicial estoppel if the U.S. Supreme Court grants certiorari in the case.
