- Abstract
The article discusses the role of empirical research in bankruptcy policymaking. It points out that while empirical data raises the level of policy debate and improve conclusions, it will never provide answers to policy questions and there are those either on the political left or right who cannot be persuaded by any data. It cites two examples from consumer bankruptcy and business bankruptcy that illustrates the importance of using empirical data and the danger of ignoring the empirical bases of policy formulations. It indicates that the relevant parts why debtors go to bankruptcy can be exposed and documented by empirical research and suggests the launching of a systematic program of research in formulating bankruptcy policy.
