- Abstract
The article focuses on the new legal rule changes recognized in the liability insurance in the U.S. by the courts and their impact on the torts. It states that the courts in the U.S. have recognized the new factors that liability insurance has introduced into the social and economic structure. It states that the U.S. courts are taking into consideration not just the physical harm but the emotional shock in the liability insurance cases. It cites lawsuit cases including, a lawsuit by the unemancipated minor against his parent and a lawsuit by one spouse against another which are indirectly suing the insurance companies and are denied recovery by the courts.
