- Abstract
The article presents the author's views regarding the First War Power Act. He finds that the First War Power Act in the Section 5(b) was intended to be uncontrolled by other Acts. The only effect of the amendment of section 5(b)is to authorize takings of property that would have been unauthorized. He also states that in characterizing Section 5(b) as an amendment to the Trading with Enemy Act, the U.S. congress has placed it in organic relationship to the judicial remedy of return embodied in the Section 9 (a) amendments.
