- Abstract
The article offers information on the position and role of expert witness in criminal cases in France, Germany and Italy. It states that the expert witness in Italy, France and Germany act as an auxiliary to the investigating magistrate or the trial judge in getting at the truth. It states that the investigating magistrate or the trail judge conducts an impartial judicial inquiry into the most important criminal cases and he is endowed with wide powers of arrest, preventive detention and search and seizure. It states that experts are necessarily employed by the investigating magistrate in the insanity plea cases by the defendants.
