- Abstract
The review discusses the expert opinion by Burgi/Igl on the legal requirements and possibilities for the establishment of Community Health Nursing (CHN) in Germany. The expert opinion was commissioned by the Robert Bosch Foundation in collaboration with the Agnes-Karl Society. It deals with the delegation or substitution of medical activities to competent non-physicians, particularly against the background of the uneven distribution of doctors in Germany and the undersupply in rural areas. The expert opinion analyzes the current legal situation and examines to what extent non-medical activities can be billed. It also makes suggestions for future legal regulations. The review praises the summary of the current legal situation and points out that the legislator must find not only professional law solutions but also performance law solutions. However, doubts are raised as to whether the considerations regarding integration into municipalities are sustainable. The expert opinion by the Monopolies Commission on hospital care after Corona recommends improvements in the existing stationary care structures. It emphasizes that quality competition can only take place where hospital planning allows it. Therefore, it is suggested to assign the IQTIG with the development of recommendations for measuring and presenting quality. The Monopolies Commission also recommends a more targeted needs planning by the federal states and prefers performance group concepts over care level concepts. Further suggestions from the expert opinion are not discussed in detail.
