- Abstract
Employee monitoring has become a widespread and growing practice in the workplace. There are various types of employee monitoring, such as for instance video surveillance, call monitoring and computer monitoring. Employers justify their practices with an increased need to protect their property and means of production, to control work performance and monitor labour discipline. Employers rarely realize that their monitoring practices may be considered a serious invasion of their employees' private lives. Legitimate interests of the employer regarding the right to protect his or her property collide with the employee right for privacy. Being the basic source of the labour law, the Labour Code regulates the fundamental principles of monitoring employees in the workplace. However, it is worth noting that the legislation adopted is problematic in practice in terms of its interpretation and application.
