- Abstract
The article focuses on judicial review of several environmental statutes and their implementation in pivotal cases including NEDC v. Brown, Abbott Laboratories v. Gardner and National Resources Defense Council v. EPA. It presents information on the decision of the U.S. Court of Appeals for the Ninth Circuit in NEDC v. Brown, wherein it was held that the U.S. Environmental Protection Agency (EPA) lacked the authority to exempt from permitting requirements of the U.S. Clean Water Act (CWA) regarding storm water runoff from forest logging roads. It discusses the U.S. Supreme Court's decision in Abbott Laboratories case, in which the validity of pre-enforcement review of EPA's rules was confirmed.
