- Abstract
The article looks at the developments to the law applicable to water in Quebec. It mentions that the concept of "res communis" or "common things," formulated in the Roman Law, is incorporated in the law of Quebec, in which fresh water cannot be property. It states that the controversy regarding the consideration of ground water and water from a spring, whether it is applied to res communis, is resolved by the Act to Affirm the Collective Nature of Water Resources and Provide for Increased Water Resource Protection. The role of the state concerning fresh water, the legal framework for the management of fresh water, including the 2009 Water Act, are discussed.
