- Abstract
The article discusses the ruling of the Ontario Court of Appeal in the case, Harbert Distressed Investment Fund L.P. and Harbert Distressed Investment Master Fund Ltd. v. General Chemical Canada Ltd. in line with the unpaid pension contributions of General Chemical. It offers an overview of the obligation of General Chemical and its interim receiver to pay cleanup costs related to its violation of environmental safety requirements. Information is presented on the security interest of the Ministry of Environment in the bankruptcy of General Chemical.
