- Abstract
The article discusses the case of Ponca Tribe of Indians of Oklahoma et al. v. Continental Carbon Company 2007 U.S. Dist. LEXIS 1529 (W.D. Oklahoma, January 8, 2007). The U.S. District Court granted part of a motion seeking dismissal of an amended class-wide personal injury claim filed by the Ponca Tribe of North American Indians and others against Continental Carbon Company. The tribe seeks creation of a medical monitoring fund. It also asserts wrongful death on behalf of Annabelle Littlehoe.
