- Abstract
The article reflects on the decision of the U.S. Ninth Circuit Court of Appeals in the case Natural Resources Defense Council Inc. v. County of Los Angeles in 2011. It says that the Ninth Circuit overturned the ruling of a district court and found the Los Angeles County Flood Control District (LACFCD) in violation of the Clean Water Act (CWA). It notes how the decision is in conflict to the 2004 Supreme Court case, South Florida Water Management District (SFWMD) v. Miccosukee Tribe of Indians.
