The article discusses a court case Ubaldini c. Rio Tinto Canada Management Inc. The plaintiff, Erika Ubaldini, sought an order requiring the company to pay survivor benefits, back payments and an award of $10,000 in moral damages. The Superior Court of Quebec had occasion to consider whether representations implying that someone was a spousal beneficiary under a pension plan could have the effect of granting that person rights under the plan even though they were not the eligible spouse.
