- Abstract
In this Article, the authors have undertaken a comparison of the differences and similarities between customary real estate legal opinion practice and customary non-real estate business transaction legal opinion practice. Comparing the 1998 Report of the TriBar Opinion Committee on third party closing opinions as representative of non-real estate legal opinion practice and the New York Mortgage Loan Opinion Report, ABA/ACREL All-inclusive Opinion, and Real Estate Opinion Letter Guidelines as representative of real estate legal opinion practice, the authors consider the meaning of and necessity of express qualifications to, the remedies opinion and the due diligence required to provide such an opinion.
