- Abstract
The article discusses the D'Arcy v. Myriad Genetics Inc. wherein former breast cancer patient Yvonne D'Arcy challenges the validity of Australian Patent No 686004 on the ground that the invention of molecular diagnostic company Myriad Genetics Inc. was not patentable. The High Court of Australia unanimously permitted the appeal on D'Arcy v. Myriad Genetics Inc and ruled that claims 1, 2 and 3 of Australian Patent No 686004 be revoked.
