In this article, the author analyzes the role of rising public use doctrine for patents and development of regulatory takings in land use litigation. The author discusses various aspects including laws for regulating land development conditions and its impact on land use litigation, judicial opinions on the U.S. Supreme Court case Pennsylvania Coal Co. v. Mahon, and the laws regulating inclusionary zoning and the land use.
