- Abstract
The article examines the U.S. Court of Appeals for the Third Circuit ruling in the case Pellegrino v. Transportation Security Administration (TSA), Division of Department of Homeland Security and explains why airline passengers should have a relief against the TSA and its officers. In its ruling, the court claimed that the TSA is covered by sovereign immunity and not liable under the Federal Tort Claims Act (FTCA).
